1. Introduction

Welcome to the digital lending platform of Nelion Finance Limited (referred to as "we", "us", "our", or the "Company"). Nelion Finance Limited is a non-deposit taking microfinance service provider, duly registered and operating in accordance with the Tanzania Microfinance Act, 2018.

By accessing, registering, or using our mobile application, web application, USSD portals, or any associated digital services (collectively, the "Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you must immediately cease accessing and using the Platform.

2. Eligibility and Customer Declarations

To access our services or apply for micro-loans through this Platform, you declare and warrant that:

  • You are a citizen or lawful resident of the United Republic of Tanzania.
  • You are at least 18 years of age and possess full legal capacity to enter into binding agreements.
  • All personal, demographic, occupational, and financial details provided during registration are accurate, truthful, and up to date.
  • You possess a verified National Identification Number (NIDA) and a registered SIM card matched with your identity.

3. Account Registration & Security (2FA)

To protect customer financial records, our Platform implements advanced security protocols, including Two-Factor Authentication (2FA) and device fingerprinting. You agree to receive verification codes via your registered mobile number or email address during logins and transaction approvals.

You are solely responsible for maintaining the confidentiality of your PIN, password, and active sessions. Any activity conducted under your registered account is deemed to be authorized by you. If you suspect unauthorized access or compromise of your credentials, you must notify us immediately at support@nelionfinance.co.tz.

4. Loan Applications and Credit Inquiries

All loan requests submitted on the Platform are subject to credit assessments, underwriting guidelines, and multiple approval phases (Collection Officer, Team Leader, and Quality Assurance review). Submission of an application does not guarantee loan approval.

You explicitly consent and authorize us to perform credit inquiries with licensed Credit Reference Bureaus (CRBs) in Tanzania, and to disclose your repayment history—including defaults—to the CRB in compliance with Bank of Tanzania (BoT) regulations.

5. Interest Rates, Fees, and Late Penalties

By accepting a loan offer, you agree to pay the principal amount, interest, and associated service fees according to the approved schedule.

  • Interest Rate: Interest is calculated using the approved cycle and rate outlined in your specific loan contract. Interest calculations match the schedule provided prior to disbursal.
  • Processing Fees: An upfront fee may be charged and deducted from the loan principal at the time of disbursement.
  • Late Payment Penalty: If any repayment is missed or delayed, a late payment charge will accrue in accordance with the specified penalty rate on the outstanding overdue amount.

All interest rates, fees, and penalties are clearly itemized in the loan calculator and contract agreement before you electronically sign and confirm the loan.

6. Mobile Money Disbursements & Repayments

All loan disbursements are routed digitally to your registered mobile money wallet (M-Pesa, TigoPesa, AirtelMoney, or Halopesa) through our payment aggregator partners (including Azampay).

Repayments must be initiated digitally through the Platform or via the authorized Paybill number. You are responsible for ensuring that sufficient funds are available in your mobile wallet to complete repayments on or before the due date. Payments are applied first against outstanding fees/penalties, then interest, and finally the principal.

7. Consent to Electronic Communications

By registering on the Platform, you consent to receive electronic communications from us, including transactional SMS alerts, account updates, upcoming payment reminders, and digital marketing materials.

Standard SMS and telecommunication network rates may apply. You may opt out of promotional messages, but you cannot opt out of vital transactional messages regarding active loans or security codes.

8. Data Privacy

We respect your personal privacy. Our handling of your demographic records, NIDA details, and business assessments is governed by our Privacy Policy and complied with the Tanzania Personal Data Protection Commission (PDPC) rules. Please review the Privacy Policy to understand our practices.

9. Limitation of Liability

To the maximum extent permitted by law, Nelion Finance Limited shall not be liable for any indirect, incidental, special, or consequential damages resulting from your use of or inability to access the Platform, network failures, mobile money provider downtime, or unauthorized use of your device.

10. Governing Law and Dispute Resolution

These Terms of Service are governed by, construed, and enforced in accordance with the laws of the United Republic of Tanzania. Any dispute arising under or in connection with these terms that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the competent courts of Tanzania.
